Every year around Oct, there is a exciting free event you can attend, and only for Non American. That is annual visa Lotto. The admission is free, I repeat, FREE. If you see any ad online or anyone told you to pay for the visa Lotto, do not do it. Because Department of state say so. It is free for every eligible person to enter. No waiting period in July-Again

Juster after USCIS announced no quota for EB1-3 immigration applicants several days ago, now they are saying that you do not need to wait again. Free H1B evaluation

There are several law firms offer free case evaluation. You got what you paid for, in this case, you paid nothing. However, you might still get some valuable information regarding your situation, especially from money sucking machine aka Lawyer. You can submit your resume and the staff in the law firm will take a look then tell you which category you might fit, either employment base, marriage, or maybe Lotto?

Again, this is free service so do not expect too much, what I got is simply a sentence recommended me to have employment base application which I already knew. You can still give it a try, it is free after all.

No quota for employment base Green Card

Last month in June the biggest news is that all waiting period for employment base green card stay "Current" but now in July, USCIS just announced that no quota for all. Conclusion, you can never know what kind of move that USCIS will make in the future so the best you can do is to apply Green Card ASAP.
It is actually not necessary to have H1B visa first to apply Green Card. You can apply Green Card straight from your F1 Student visa. Consult with your lawyer for more detail.

Usually, afer several years working under H1B visa, you will apply immigration visa. As you know, there are several immigration via work immigration category, EB1,EB2,EB3. I am not a lawyer but I know that one law office announced that there will be no waiting period for all immigration via work in the month of July. Yes, even people from China and India. H1B visa application fee plans to be increased

Congress plans to increase H1B visa application to be 5,000 USD. If passed, this law will increase financial burden to those company that would like to sponsor aliens. Congress claim those increased fee will help U.S. citizen education funding. While illegal immigrants get some quick green card , those highly educated aliens once again to be the target. The companies that hired qualified alien will be punished for high application fee.

Squeezed Visa

While now Senate almost pass legalize illegal immigrants by giving Z visa or such..paying 5,000 fine over 8 years, "learn English", I was wondering how about the rights for those who are highly educated people who earned masters or even PhD degree can ever pursue their American Dream without outrageous difficulty. Senates investigate H1B visa

Washington post said there are nine companies occupied 20,000 H1B visa quota which is a little bit too many for nine companies. Senates are looking into it. They are some kind of outsourcing company and just occupied quota first then let their "employee" to find a real job later. This event might somehow impact H1B visa debate currently going on in the Senate. Job seeker should be pay attention to this kind of "consultant " or "outsourcing" company.

USCIS announced 2008 master degree H1B visa quota get used up on April 30. USCIS will still accept H1B renew, switch employee, change current H1B labor condition, nonprofit organization jobs H1B application(exempt from the quota), and applicants from Singapore an Chile.

The remaining quota might just used up couple days later, for those who are still looking for job, I suggest you just take the offer if there is one and secure your spot in the quota. H1B visa master degree quota update April 19

According to the news from USCIS, there are about only 3,000 quota left for master degree holder. The clock is ticking and ticking fast. If you think 3,000 is a lot and you will be safe, don't forgot last time I updated the number of quota left on April 10 is 7,000. It takes only 9 days to consume almost 4,000 quota. Random selecton for 2008 H1B visa

As you know that 2008 H1B 65000 quota get used up and now USCIS start to randomly select applications on April 12. Even though you received the receipt, it does not mean that you are approved. You will still need to wait for USCIS publish the result. Of course, for those who submit your application on April 1 before the quota ran out, your spot should be secured.

OK, time to reveal how many quota left for those who hold master degree from USA. You will need to have master degree earned in USA in order to qualify. According to the news, there are 7,000 left as today. So if you are still working on your application, keep on going. 20,000 master degree holder H1B visa quota

2008 H1B used up quota are those under non-master degree holders.USCIS did not say whether 20,000 quota for master degree holders get used up or not. (at least not this moment) I am guessing that they are going to run out pretty soon. Last year, if I remember it correctly, quota for master degree holders got used up on April 23.This year standard6,5000 quota running out almost the first day of April, I do not think Master degree quota will last longer than last year.

2008 H1B quota is used up

For those who would like to apply H1B visa and have not done so while you are reading this article. Don't bother. Because 2008 H1B Visa quota get used up. Even the applications on April 2 and 3 will be in drawing. If you submit the application on April 4, your application will be returned.

This year takes less time to use up the quota compared with last year. That is why you will need to check if the company that you are looking for is going to sponsor you or not. Check out here

2008 H1B application starts April 2

This year, H1B application starts April 2 because April 1 is Sunday. It is safer to submit application after April 2 instead of March 31. Again, you can not work until October this year if you do not have OPT or any other working permit. Your application will for sure be returned if you submit before March 30. There is a lawyer saying that even the job title is not that "pretty", if you get paid enough, you will have a better chance to be granted. So please check your salary before you apply to avoid your money.

Process Premium H1B

Process expedite premium H1B visa will cost you 1000 dollars. Should you throw a grand or not? Well, people say time is money, if you can use money to buy time, why not? While you are still waiting for your H1B visa result, have you ever thought that you might not get it? If you are in OPT, you are wasting time waiting for the H1B which is not approved. It might takes months and you are suppose to use those precious time to find another job. I personally used premium process H1B visa and I knew that I did not waste anytime if my H1B did not go though. It takes me two weeks to know the result. How do I get my H1B visa part 2

So what should you do if you try to get a job here in USA? Do as American do. Get some internship to build your working history here in the states. Even you got paid nothing. Yes, you read it right, even you got paid nothing. Do you still want to get something other than experience? Go to your school's international student office and apply one permit called CPT to earn credits to your degree. Even though you get paid nothing, you still earning credits, not bad at all. Some internship might end up to permanent position.

If you go to Check out your H1B job salary and find out your dream company does not have sponsor record, what should you do? Easy, make yourself be the first person to be sponsored. How? ask your lawyer or explain how this works. If the company does sponsor, please check your H1B job salary and you will know if the company pay you fairly. If the company fail to pay at standard, actually it might not be a good idea to work there.

All the job searching techniq is the same, you just need to make sure you are not underpaid because some bad company think they can take advantage of you since you require sponsorship.

How do I get my H1B visa part 1

I am now working under H1B visa. Like most H1B holder, I came to USA as an international student first, then applied OPT after finishing my degree.One year OPT usually is not that enough for job hunting considering most of the companies are hesitating hiring non-residents.

That is why you need to prepare yourself as soon as possible. Even though you are from top tier school , as a non-resident , chances are either HR in the company have little or no knowledge about H1B application , or they will reject you due to application complication and fear not to protect local labor force. I have heard a person got an offer from big commnication company ,because of its bureacy , it takes a while to process internal paper work and miss the application quota.

If you have been working in your home country for years and imagining American companies will hungry for your talent think twice. The company you worked before might only famous in your country and most of the American are not aware. Even the company you worked before in home country is international cooperation, they might still doubt your ability to work here.

For H1B job seeker, you should know if the company you apply job from ever sponsored H1B visa. If they do, how much is your job should be paid. You should not get paid less than what is the minimum salary for that certain position. This is the regulation.

For non-H1B job seeker, you should know if your company is paying less than it requires to pay H1B workers. If your company does pay less, you know that your company violate the regulation.

How much did the company pay H1B worker before and you will have better idea of how much you should ask. Maybe you do not even have to bother because the company you apply does not sponsor before, most likely they now will not either.

Q:What if the company I am looking for does not have any H1B data, will I still be charged?
A: No. Right now you will not be charged if there is no data available. If you are charged, you will have full refund.
